Cummings, Ranking Member of the House Committee on Oversight and Government Reform, received a plaque from the Coalition Against Bigger Trucks (CABT) in honor of his vote opposing a transportation infrastructure provision intended to permit heavier and longer trucks on the nation&rsquo;s highway system.<br /><br />The CABT is comprised of several organizations &ndash; including the National Troopers Coalition, National Sheriffs Association, National Association of Police Organizations, and AAA &ndash; and works to ensure that Washington heeds the warning of law enforcement officers, EMTs, and motorists, to limit the size of trucks on the roadways.&nbsp;</p><p style="text-align: left;">The provision that the Congressman voted against would have permitted triple-trailer trucks on the nation's highways and roadways.<br />&nbsp;</p>]]>

Cummings, Ranking Member<br /><br />Subcommittee on the Federal Workforce, U.S. Postal Service and Labor Policy<br />Hearing on &ldquo;Hatch Act:&nbsp; Options for Reform&rdquo;<br /><br />May 16, 2012</b></p><p style="text-align: left;"><br /><br /><b>&ldquo;This bill provides immediate, common-sense, and non-controversial fixes to the Hatch Act.&nbsp; Specifically, it implements recommendations for immediate reform proposed by Special Counsel Carolyn Lerner.&nbsp;&nbsp; </b><br /><br />&ldquo;First, the bill eliminates the restriction that prevents state and local government employees from running for political office.&nbsp; Currently, if a state or local government employee works on a program that receives any amount of federal funding, the Hatch Act prohibits that employee from running for office.</p><p style="text-align: left;"><b>&ldquo;This restriction has led to a number of unjust results for public servants.</b>&nbsp; For example, today we will hear from Jon Greiner, the former police chief for the City of Ogden, Utah, who was removed from his position because he ran for state senate.&nbsp; In another example, a Philadelphia transit cop was barred from running for his local school board because he works with an explosives detection dog paid for by a grant from the Department of Homeland Security.<br /><br /><b>&ldquo;These results make no sense.&nbsp; Even worse, the Office of Special Counsel reports that 45% of its caseload now involves enforcing this restriction, diverting resources from more critical issues.</b><br /><br />&ldquo;The Hatch Act Modernization Act also implements a second recommendation made by the Special Counsel.&nbsp; It expands the range of penalties for Hatch Act violations.&nbsp; Right now, an employee who commits a Hatch Act violation&mdash;no matter how minor&mdash;must be fired unless the Merit Systems Protection Board unanimously votes to impose a lesser penalty.&nbsp; This bill makes it easier for the punishment to more appropriately fit the violation.<br /><br />&ldquo;Finally, the bill includes a third provision to treat employees working for the District of Columbia as state and local government employees rather than as federal employees.&nbsp; This provision is based on legislation championed by Congresswoman Norton that passed the House by voice vote in the 111th Congress.&nbsp; We will hear today from the Attorney General of the District of Columbia that without this change, he will not be able to run for another term in 2014.&nbsp; That just does not make sense.<br />&nbsp;&ldquo;Mr. Chairman, this bill is simple, straightforward, and noncontroversial.&nbsp; Last June, at our first hearing on the Hatch Act, Chairman Issa said the Committee would consider Hatch Act legislation before the election.&nbsp; He said this:<br />&nbsp;</p><p style="text-align: center;"><br />The Oversight Committee is intending to author such legislation as may be necessary and will affect the next President.&nbsp; Necessarily, we will, in fact, work on a bipartisan basis to find any and all changes necessary to take effect upon the inauguration of the next President.&nbsp; Although this is 18 months and it seems like a long time, in political time it is very short.</p><p style="text-align: left;"><br /><br />&ldquo;The Chairman was right.&nbsp; That was nearly a year ago, and time is running out.&nbsp; <b>Although I support additional efforts to improve the Hatch Act, H.R. 4152 includes common-sense fixes that the Special Counsel needs now, before the election.&nbsp; These provisions have widespread support, and we can pass them immediately.</b><br /><br />&ldquo;Mr. Chairman, I hope we can work together to schedule a markup for May 31 when we return from the Memorial Day recess.<br /><br />&ldquo;There are many public servants&mdash;police officers, social workers, and paramedics&mdash;who want to serve their country by holding public office.         <![CDATA[<p>Washington, DC (May 15, 2012)&mdash;Today, the Ranking Members of three House Committees&mdash;Rep. Elijah E. Cummings of the Oversight and Government Reform Committee, Rep. Bob Filner of the Committee on Veterans&rsquo; Affairs, and Rep. Adam Smith of the Armed Services Committee&mdash;joined several other Members in introducing legislation to enhance the Servicemembers Civil Relief Act (SCRA), a law intended to protect against improper foreclosures, evictions, and other negative financial consequences of military service.<br /><br />&ldquo;Our troops fighting overseas in Iraq or Afghanistan should not have to fight here at home just to keep a roof over the heads of their loved ones,&rdquo; Cummings said. &ldquo;This bill will expand current law to protect more of our brave men and women in uniform from losing their homes while they protect our freedoms abroad.&rdquo;<br /><br />&ldquo;Our servicemembers protect our country, our way of life and our homes,&rdquo; said Filner. &ldquo;We can do no less to protect their homes against mortgage foreclosure.&nbsp; I applaud my colleague Representative Cummings for fashioning a bill making important improvements to the Servicemembers Civil Relief Act and for including language from my bill, H.R. 1263, to extend protections to surviving spouses of servicemembers whose death is service-connected.&nbsp; I call on all Members of Congress to join us in moving forward with this important legislation that will give servicemembers better protections against mortgage foreclosure.&rdquo;<br /><br />&ldquo;Our servicemembers and their families act selflessly to protect our country and ensure national security, sometimes making the ultimate sacrifice,&rdquo; said Smith. &ldquo;The last thing they should have to worry about while they serve is the financial security of their families and their homes.&nbsp; This bill takes a much-needed step toward protecting deployed servicemembers and their families, discharged veterans with a 100 percent service-connected disability, and surviving spouses.&rdquo;<br /><br />The American Legion, Veterans of Foreign War, Paralyzed Veterans of America, and Disabled American Veterans have all issued letters in support of the legislation, entitled the Military Home Foreclosure Protection Act.<br /><br />Without Congressional action, several current SCRA provisions will sunset at the end of this year.&nbsp; In addition to eliminating this sunset provision, the legislation would:<br /><br />&bull;&nbsp;&nbsp;&nbsp; expand SCRA protection to:<br />o&nbsp;&nbsp;&nbsp; servicemembers serving in support of contingency operations;<br />o&nbsp;&nbsp;&nbsp; surviving spouses of servicemembers whose death is service-related; and <br />o&nbsp;&nbsp;&nbsp; veterans who are 100% disabled at the time of discharge due to service-connected injuries.<br />&bull;&nbsp;&nbsp;&nbsp; stay foreclosure proceedings for 12 months, a three month increase; <br />&bull;&nbsp;&nbsp;&nbsp; increase civil penalties for SCRA violations;<br />&bull;&nbsp;&nbsp;&nbsp; prohibit banks from discriminating against servicemembers who are eligible for protections under SCRA;<br />&bull;&nbsp;&nbsp;&nbsp; require lenders to designate a compliance officer to ensure that they protect the legal rights of servicemembers; and<br />&bull;&nbsp;&nbsp;&nbsp; provide a toll-free telephone number and website for servicemembers dealing with SCRA problems.<br /><br />Cummings, Filner, and Smith plan to introduce the legislation as an amendment to the National Defense Authorization Act being considered by the full House this week.<br /><br />On July 12, 2011, Cummings and Senator Jay Rockefeller held a congressional forum on the SCRA, and Cummings released an investigative report, &ldquo;Fighting on the Home Front&rdquo; about the growing problem of foreclosures against U.S. servicemembers.</p><p style="text-align: center;">###</p><p>&nbsp;</p>]]>

        <![CDATA[<p>Washington, DC (May 10, 2012)&mdash;Today, the House Armed Services Committee passed legislation that includes Two provisions authored by Rep. Elijah E. Cummings, Ranking Member of the House Committee on Oversight and Government Reform, and other Members to enhance diversity and eliminate hazing in the military.<br />&nbsp;<br />&ldquo;It is critical that Congress do everything in our power to promote a highly qualified and diverse officer corps that truly represents our nation, and these provisions are an essential step toward achieving this goal,&rdquo; said Cummings. <br />&nbsp;<br />Yesterday, the House Armed Services Committee passed the National Defense Authorization Act (NDAA), which includes the Military Leaders Enhancement Act (H.R. 2186), legislation originally authored by Cummings. <br /><br />The bill would provide $5 million for the armed services to develop a comprehensive plan on diversity, determine metrics to measure progress, and provide an annual report to Congress.&nbsp; It would also require the Defense Department to develop a standardized definition of diversity and provide demographic data on women and minorities in the military.&nbsp; The bill was introduced as an amendment by Reps. Johnson, Sanchez, and Reyes in the House Armed Services Committee.<br />&nbsp;<br />The NDAA also includes a provision originally introduced by Reps. Chu, Cummings, and Honda as part of The Harry Lew Military Hazing Accountability and Prevention Act of 2012.&nbsp;&nbsp; <br /><br />This provision would require the Department of Defense to develop a comprehensive plan to prevent hazing and a national database to track hazing incidents.&nbsp; It would also direct the Secretary to submit recommendations to the Uniform Code of Military Justice and Manual for Courts Martial to improve efforts to address hazing incidents.<br />&nbsp;<br />&ldquo;We must do all we can to eradicate hazing from our armed services and ensure that our servicemembers are held to the highest standards,&rdquo; said Cummings. &ldquo;This legislation will put in place key measures to curb hazing and hold accountable those who commit such heinous acts.&rdquo;<br />&nbsp;<br />Cummings has been a strong advocate for diversity in the military and Coast Guard for many years.&nbsp; In 2009, Cummings joined Senator Ben Cardin and other Members to establish the Military Leadership Diversity Commission in order to conduct a comprehensive evaluation of the policies related to the promotion of women and minorities in the armed services.&nbsp; <br /><br />A recent forum co-hosted by Cummings, Cardin, and the Chairs of the Tri-Caucus revealed that the armed services had failed to fully implement 14 out of 19 of the Commission&rsquo;s recommendations. <br />&nbsp;<br />The full House is expected to consider the NDAA next week.<br /><br />###</p>]]>

Cummings, the Ranking Member of the House Committee on Oversight and Government Reform, issued the following statement from the House Floor on the budget reconciliation measure, H.R. 5652 (Sequester Replacement Reconciliation Act of 2012).<br /><br />&ldquo;This week marks the 28th anniversary of Public Service Recognition Week, a week in which we honor the contributions of federal, state, and local government employees.&nbsp; <br /><br />&ldquo;These employees include outstanding public servants like the IRS&rsquo; Shauna Henline from Rep. Rob Bishop&rsquo;s congressional district, who saved the U.S. taxpayer billions of dollars by identifying and bringing to justice tax evaders and scammers.<br /><br />&ldquo;They include the State Department&rsquo;s Shane Morris, a constituent of Rep. Christopher Smith of New Jersey, who played a critical role in ensuring that U.S. diplomats in the Middle East continued to receive classified information, material, and equipment during the Arab Spring uprisings in 2011.<br /><br />&ldquo;Instead of using this week to celebrate the good work of government employees who dedicate their lives to serving others, the Republican Majority has put legislation on the House floor today that would take billions of dollars out of their pockets.&nbsp; <br /><br />&ldquo;I ask my colleagues on the other side of the aisle, where is the appreciation or compassion for the dedication and commitment that public employees display day in and day out?&nbsp;&nbsp; It certainly is not in this bill, which is an uncompassionate and wrong-headed approach to our fiscal problems.<br /><br />&ldquo;The federal employee-related provisions in this bill, which were reported out of the Oversight and Government Reform Committee, would reduce the take-home pay of nearly 3 million middle-class American workers by 5% by mandating increased retirement contributions.<br /><br />&ldquo;The bill also would eliminate the FERS annuity supplement for new workers who retire before they are eligible for Social Security at age 62.&nbsp; According to the Office of Personnel Management, the average annuity amount for current FERS retirees is nearly $700 per month.&nbsp; <br /><br />&ldquo;I do not think any American who has dedicated his or her life to public service should be forced to lose that much money on a monthly basis, particularly those on a fixed retirement budget.&nbsp; <br /><br />&ldquo;Our middle class federal employees have already contributed $75 billion towards deficit reduction and other government programs, while millionaires and billionaires have not been asked to contribute one additional cent to improve our government&rsquo;s financial condition.&nbsp; <br /><br />&ldquo;I strongly urge my colleagues to oppose this legislation and instead support a more rational and equitable budget proposal that asks for shared sacrifice from everyone in our country.<br /><br />&ldquo;I thank the gentleman from Maryland for the time and I yield back the balance.&rdquo;</p><p style="text-align: center;">###<br />&nbsp;</p>]]>

        <![CDATA[<p>Washington, DC (May 9, 2012)&mdash;Today, Rep. Elijah E. Cummings, the Ranking Member of the House Committee on Oversight and Government Reform, issued a statement in support of a new alternative proposal by the Postmaster General to reduce window service times at rural post offices before moving to close or consolidate them.&nbsp; <br /><br />&ldquo;We have to see the details, but the Postal Service&rsquo;s new proposal seems like a sensible compromise for preserving service for millions of Americans and achieving hundreds of millions of dollars in much-needed savings,&rdquo; said Cummings.&nbsp; &ldquo;In many rural towns and neighborhoods, the post office is the federal government&rsquo;s only presence in the area.&nbsp; I am encouraged that the Postmaster General is revisiting the idea of shuttering thousands of post offices while also recognizing the need to bring Postal Service operations in line with reduced mail volume.&rdquo;<br /><br />The recommended plan, which would be carried out over a two-year period, would allow many of these Post Offices to operate at six, four, or even two-hour intervals, thereby maintaining service for individual and commercial customers.&nbsp; The Postal Service plans to submit this alternative plan to the Postal Regulatory Commission for review later this month.<br /><br />Since 2007, the Postal Service has faced financial challenges as a result of the increase in electronic communications, the recent economic slowdown, and a statutory mandate to prefund retiree health care benefits at an accelerated rate.&nbsp; In order to preserve the Postal Service&rsquo;s long-term viability, Congress is currently considering&nbsp; comprehensive postal reform legislation.<br /><br />Ranking Member Cummings has introduced H.R. 2967, the Innovate to Deliver Act, and has urged the House of Representatives to pass legislation that avoids the unnecessary closure of post offices and mail processing facilities while still addressing the Postal Service&rsquo;s ongoing financial challenges.</p><p style="text-align: center;">###</p>]]>

Her submission, a painting entitled &quot;Unity,&quot; was selected to be displayed for one year in the Cannon tunnel to the U.S. Capitol by a panel of judges from Baltimore's fine arts community.<br />

Ms. Ryan also received a congressional citation and a gift certificate from Southwest Airlines.&nbsp; She will join Congressional Art Competition winners from across the country at a Washington, DC, reception in their honor on June 20, 2012.<br />

Cummings, Ranking Member of the House Committee on Oversight and Government Reform, joined Representatives Judy Chu, Mike Honda, and other House Members in introducing legislation to prevent hazing in our armed services.&nbsp; The Harry Lew Military Hazing Accountability and Prevention Act of 2012 would: <br /><br />1.&nbsp;&nbsp;&nbsp; Create a national database to track hazing incidents and help the military determine their causes;<br />2.&nbsp;&nbsp;&nbsp; Provide a statutory definition of hazing in the Uniform Code of Military Justice to ensure that hazing is a prosecutable crime;<br />3.&nbsp;&nbsp;&nbsp; Require an independent GAO study on each of the services&rsquo; hazing training and prevention policies along with the prevalence and consequences of hazing over the last five years; and<br />4.&nbsp;&nbsp;&nbsp; Require the Department of Defense to develop a comprehensive plan to address hazing throughout the armed services.<br /><br />The lawmakers released the following statements about their bill:<br /><br /><br />Congressman Elijah Cummings (MD-07):&nbsp; &ldquo;Hazing is simply intolerable and has no place in our military.&nbsp; Now is the time for our military leadership to take decisive action to address and prevent such violent acts against our servicemembers, and to continue to create a culture of diversity that represents and celebrates the richness of our nation.&rdquo;<br /><br />Congresswoman Judy Chu (CA-32): &ldquo;I lost my nephew, Lance Cpl Harry Lew, to military hazing in April of last year.&nbsp; Since that day, the military has been a perpetual disappointment &ndash; both in failing to deliver justice for Harry&rsquo;s death and in their lack of attention to hazing within their ranks.&nbsp; Since the moment I began speaking out about this abuse in our armed services, the military has maintained that they don&rsquo;t have a problem &ndash; that they are handling this issue perfectly.&nbsp; How can they claim they are doing everything perfectly if they don&rsquo;t even have anti-hazing policies or training?&nbsp; How can they know they are doing everything perfectly if they don&rsquo;t even know how many people are hazed?&nbsp;&nbsp; They can&rsquo;t.&nbsp; And that&rsquo;s exactly why we&rsquo;re introducing this bill.&nbsp; We are taking action because it has become abundantly clear over the past year that the military won&rsquo;t.&nbsp; This is about committing to protect our troops, just as our troops have committed to protect the America people.&nbsp; It&rsquo;s about time something is done before another service member is harmed in such a preventable way.&rdquo;<br /><br />Congressman Mike Honda (CA-15):&nbsp; &ldquo;Learning from the tragic cases of Marine Lance Corporal Harry Lew and Army Private Danny Chen, we must act now to ensure that the Department of Defense has effective hazing and harassment prevention and accountability policies.&nbsp; A recent hearing by the House Armed Services Subcommittee on Military Personnel helped to identify the lack of a simple definition for hazing and harassment across the Services, much less a comprehensive prevention policy.&nbsp; This bill would provide the Pentagon with the necessary tools to effectively address the problem of hazing and harassment in the military, in order to guarantee that our brave service members are able to safely and honorably defend the citizens and the Constitution of the United States.&rdquo;<br /><br /><br />BACKGROUND:&nbsp; On March 6, Cummings, Senator Ben Cardin, and the Congressional Tri-Caucus (Congressional Asian Pacific American Caucus, Black Caucus, and Hispanic Caucus) held a forum on military hazing and diversity in the armed services and the Coast Guard. The forum, and a later hearing held by the House Armed Services Committee on March 22, revealed several deficiencies and a lack of a coordinated response by the Department of Defense and the Coast Guard to deter, address, and track hazing incidents.<br />&nbsp;<br />The case of Lance Cpl. Harry Lew, Rep. Chu&rsquo;s nephew, brought heightened attention to the problem of military hazing over the last year.&nbsp; Sadly, his is only one of the more well-known instances. <br />&nbsp;<br />Private Danny Chen was reportedly tormented about his race and suffered physical abuse from basic training until his suicide in Afghanistan last October.<br />&nbsp;<br />In May 2011, Private Hamson Daniels McPherson, Jr., committed suicide after facing near constant racial hazing.<br />&nbsp;<br />A year earlier, Army Specialist Brushaun Anderson shot himself after enduring verbal harassment and being forced to wear a plastic trash bag at all times.<br />&nbsp;<br />In June 2011, the Coast Guard punished seven crew members of a cutter after a two-year investigation into sexual hazing.&nbsp; <br /><br />On April 25, 2012, Army Specialist Jarrett Wright made public the sexual abuse he endured after joining a unit that called itself &ldquo;Crazy Troop.&rdquo;&nbsp; According to Jarrett, all newcomers experienced some sort of initiation, but he was the only one brave enough to go public.</p><p>&nbsp;</p><p style="text-align: center;">###</p>]]>

Cummings, a senior Member of the House Committee on Transportation and Infrastructure, made the following statement during a hearing in the Subcommittee on Economic Development, Public Buildings and Emergency Management regarding the extravagant spending at a 2010 GSA conference:</span></span></p><p class="MsoNormal"><span style="font-size: medium;"><span style="font-family: Times New Roman;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &ldquo;Thank you Mr. Chairman.&nbsp; At today&rsquo;s hearing, we have an opportunity to continue to review the actions of GSA employees who organized and participated in the 2010 conference in Las Vegas.</span></span></p><p class="MsoNormal"><span style="font-size: medium;"><span style="font-family: Times New Roman;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Yesterday, at a hearing before the Oversight Committee, we heard testimony from Inspector General Brian Miller, who is here again today.&nbsp; Mr. Miller, I want to thank you again for bringing to light this gross abuse of taxpayer funds and for your office&rsquo;s year-long investigation of this issue.</span></span></p><p class="MsoNormal"><span style="font-size: medium;"><span style="font-family: Times New Roman;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Mr. Miller&rsquo;s report yesterday was very troubling.&nbsp; For example, he <span style="color: rgb(51, 51, 51);">described the actions of Jeff Neely, a career GSA employee for many years and a senior-level executive in the Pacific Rim region based in San Francisco.&nbsp; Although Mr. Neely is not the only official implicated in this investigation, his role as the host of the 2010 conference has raised significant questions.</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">According to the Inspector General&rsquo;s investigation, Mr. Neely engaged in a pattern of misconduct that included violating federal travel and procurement rules, holding lavish parties in luxury suites, and allowing his wife and other non-government officials to participate in some of these events at taxpayer expense.</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">As I said at yesterday&rsquo;s hearing, Mr. Neely disregarded one of the most basic tenets of government service&mdash;he treated taxpayer funds as if they were his own. </span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">We also heard troubling new accounts from the Inspector General that Mr. Neely may have retaliated against other GSA employees who tried to object to his actions and rein in this lavish spending.&nbsp; According to one witness who spoke with the Inspector General, one GSA employee was &ldquo;squashed like a bug&rdquo; when she tried to object to Mr. Neely&rsquo;s actions.</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">As the Inspector General also told us, one witness was so scared of potential reprisal from Mr. Neely that she asked to be treated as a confidential informant.</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">These reports, although they certainly do not justify Mr. Neely&rsquo;s actions, may help explain why these improper activities apparently went on for so long.&nbsp; Witnesses reported to the Inspector General that the conference in Las Vegas in 2010 was just the latest in a series of conferences over many years where lavish and extravagant spending had become the norm.</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">As we heard yesterday, this issue was not brought to light until it was reported to the Inspector General by the Deputy Administrator of GSA, Susan Brita, who is here today.&nbsp; Ms. Brita, who is a top-level Democratic political appointee, should be commended for her actions, not only in reporting these abuses, but also for insisting that action be taken to address them. </span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">&nbsp;</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">At yesterday&rsquo;s hearing, Mr. Neely invoked his right under the Fifth Amendment to remain silent, and the Committee excused him from testifying.&nbsp; The Inspector General also confirmed for the Oversight Committee that has referred this case to the Department of Justice.</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">Today, we will have the opportunity to continue examining this issue in detail, including hearing from other GSA officials who were involved, including Bob Peck, the former Commissioner of GSA&rsquo;s Public Building Service, who apparently condoned and sanctioned the actions of Mr. Neely.</span></span></span></p><p style="margin-bottom:0in;margin-bottom:.0001pt;text-indent:.5in"><span style="font-size: medium;"><span style="font-family: Times New Roman;"><span style="color: rgb(51, 51, 51);">Finally, let me close by noting that there are millions of government workers across the country who dedicate their entire lives to public service.&nbsp; Elijah Cummings, the Ranking Member of the House Committee on Oversight and Government Reform, issued the following statement in response to the House GOP budget plan released today:<br /><br />&ldquo;The House Republican budget plan is misguided, utterly unfair, and should be rejected outright.<br /><br />&ldquo;I am very disappointed that the House GOP has once again unveiled a budget that directly attacks the federal workforce by extending pay freezes, increasing retirement contributions, and arbitrarily slashing the overall size of the federal workforce.&nbsp;Federal workers are currently contributing $75 billion towards deficit reduction even though they did not cause our nation&rsquo;s budget problems, yet Congress has yet to ask the wealthiest Americans to contribute even one additional penny toward these goals.&nbsp;The Republican proposal would take an additional $368 billion out of the pockets of millions of these middle-class workers over the next ten years. <br /><br />&ldquo;The House GOP plan also takes the wrong approach on Medicare, which has been a pillar of retirement security for America&rsquo;s seniors for over fifty years.         <![CDATA[<p style="text-align: center;"><span style="font-size: medium;"><b>Sandra Fluke Finally Testifies Before Congress</b></span><br />Reacts to Nationwide Campaign to Roll Back Access to Contraceptives</p><p>(Washington, DC) -&nbsp; Democratic Leader Nancy Pelosi, Oversight Committee Ranking Member Elijah Cummings, and Congresswomen Eleanor Holmes Norton and Carolyn Maloney held a Democratic Steering and Policy Committee event today to hear testimony from Sandra Fluke, the Georgetown University law student who was denied the opportunity to appear at a Committee hearing&nbsp; last week to discuss the critical importance of contraceptives to millions of women across the country.<br /><br />During her testimony today, Fluke responded to questions from Ranking Member Cummings about the nationwide campaign being conducted at both the state and federal levels to roll back women&rsquo;s access to contraceptives.&nbsp; &ldquo;Contraception when it first became available was a revolution in this country,&rdquo; said Fluke. &ldquo;It allowed women to enter employment and educational opportunities that had previously not been accessible because they were unable to control their reproduction in the same way. I just cannot imagine rolling back the clock on that progress.&rdquo;&nbsp; <br /><br />Cummings praised Fluke for giving voice to millions of women across the country.&nbsp; &ldquo;Now you have not only the Congress listening to you, but you have the country listening to you, and that is a powerful, powerful thing,&rdquo; said Cummings.&nbsp; <br /><br />BACKGROUND ON NATIONWIDE CAMPAIGN TO ROLL BACK WOMEN&rsquo;S ACCESS TO CONTRACEPTIVES<br /><br />&nbsp;&nbsp;&nbsp; During a hearing before the House Committee on Oversight and Government Reform on February 16, 2012, Chairman Darrell Issa refused to allow third-year Georgetown law student Sandra Fluke to testify about the critical importance of contraceptives to millions of women across the country.&nbsp; Claiming that the hearing would address only issues relating to religious freedom, Chairman Issa stated that Ms. Fluke is &ldquo;a college student who appears to have become energized over this issue,&rdquo; that she is not &ldquo;appropriate or qualified&rdquo; to testify, and that she does &ldquo;not have the appropriate credentials&rdquo; to appear before the Committee.<br /><br />&nbsp;&nbsp;&nbsp; Recent efforts to use religious and moral grounds to deny women coverage of birth control are not isolated incidents, but rather part of a nationwide campaign being conducted at both the state and federal levels to outlaw many forms of commonly used contraceptives.&nbsp; These efforts include legislation and ballot initiatives in various states, as well as legislation proposed in the U.S. House of Representatives and U.S. Senate that are intended to outlaw the pill, emergency contraceptives, and intrauterine devices (IUDs).<br /><br />State Proposals to Outlaw Contraceptives<br />&nbsp;<br />&bull;&nbsp;&nbsp;&nbsp; Legislation has been introduced in at least 11 states to make many forms of commonly used birth control illegal.&nbsp; These legislative efforts broadly define &ldquo;personhood&rdquo; as beginning at the moment of conception or fertilization.&nbsp; There are also ongoing efforts in eight states to define personhood via ballot initiatives.&nbsp; These vaguely worded, sweeping bills and initiatives would extend the protections of state law to a fertilized egg even before implantation.<br /><br />&bull;&nbsp;&nbsp;&nbsp; These initiatives are intended to outlaw commonly used forms of contraception that interfere with implantation and certain in-vitro fertilization techniques.&nbsp; Proponents of such initiatives have stated that they would outlaw commonly used forms of contraceptives that affect implantation of the egg, emergency contraceptives, IUDs, and certain in-vitro fertilization techniques.<br /><br />&bull;&nbsp;&nbsp;&nbsp; A state judge in Nevada required proponents of a ballot initiative to provide this explicit description of exactly what the initiative would outlaw:<br /><br />The initiative would protect a prenatal person regardless of whether or not the prenatal person would live, grow, or develop in the womb or survive birth; prevent all abortions even in the case of rape, incest, or serious threats to the women&rsquo;s health or life, or when a woman is suffering from a miscarriage, or as an emergency treatment for an ectopic pregnancy.&nbsp; The initiative will impact some rights Nevada women currently have to utilize some forms of birth control, including the &ldquo;pill;&rdquo; and to access certain fertility treatments such as in vitro fertilization.&nbsp; The initiative will affect embryonic stem cell research, which offers potential for treating diseases such as diabetes, Parkinson&rsquo;s disease, heart disease, and others.<br /><br />&bull;&nbsp;&nbsp;&nbsp; Medical and legal experts have raised concerns that these initiatives could have far-reaching implications for women&rsquo;s health.&nbsp; For example, these initiatives could make it illegal for doctors to treat pregnant women for cancer if the treatments could endanger the fetus.<br />&nbsp;&nbsp;&nbsp; <br />&bull;&nbsp;&nbsp;&nbsp; State legislators across the country have introduced bills to deny contraception coverage to more women in several states.&nbsp; Bills to create exemptions to existing state contraception mandates or to broaden existing exemptions have been introduced in states including Arizona, Indiana, Missouri, New Hampshire, New Jersey, and Pennsylvania.<br /><br />Federal Proposals to Outlaw or Deny Coverage of Contraceptives<br /><br />&bull;&nbsp;&nbsp;&nbsp; Federal &ldquo;Morality&rdquo; Legislation:&nbsp; <br /><br />&bull;&nbsp;&nbsp;&nbsp; On March 17, 2011, Representative Jeff Fortenberry (R-NE) introduced H.R. 1179, the Respect for Rights of Conscience Act of 2011.&nbsp; This legislation, which now has 209 co-sponsors in the House of Representatives, would allow any employer, including for-profit private sector companies, to deny insurance coverage for contraceptives if doing so is contrary to their religious beliefs or &ldquo;moral convictions.&rdquo;&nbsp; This would include the pill, condoms, IUDs, and any other contraceptives viewed as morally objectionable by the company.<br /><br />&bull;&nbsp;&nbsp;&nbsp; On August 2, 2011, Senator Roy Blunt (R-MO) introduced the Senate version of this legislation, S. 1467, which now has 37 co-sponsors.&nbsp; He also filed it as an amendment to the federal highway reauthorization bill.<br /><br />&bull;&nbsp;&nbsp;&nbsp; In addition to allowing companies to deny insurance coverage for contraceptives, this &ldquo;morality&rdquo; legislation would allow companies to deny coverage for a host of other essential healthcare services.&nbsp; Based on undefined &ldquo;moral convictions,&rdquo; a company could refuse to cover:<br /><br />&bull;&nbsp;&nbsp;&nbsp; prenatal testing and care, such as routine sonograms or amniocentesis;<br />&bull;&nbsp;&nbsp;&nbsp; HIV/AIDS screenings;<br />&bull;&nbsp;&nbsp;&nbsp; Type-2 Diabetes screenings;<br />&bull;&nbsp;&nbsp;&nbsp; mental health treatment for depression; or<br />&bull;&nbsp;&nbsp;&nbsp; screenings for infections that cause cervical cancer.<br /><br />Federal &ldquo;Personhood&rdquo; Legislation:<br /><br />&bull;&nbsp;&nbsp;&nbsp; The Life at Conception Act:&nbsp; In 2011, Rep. Duncan Hunter (R-CA) introduced H.R. 374 to extend the rights in the Equal Protection Clause of the 14th Amendment to &ldquo;the moment of fertilization ... or other moment at which an individual member of the human species comes into being.&rdquo; This legislation, which now has 111 co-sponsors in the House of Representatives, is similar to the language of state ballot initiatives to outlaw many forms of commonly used contraceptives.&nbsp; On January 25, 2011, Senator Roger Wicker (R-MS) introduced the Senate companion, S. 91.<br /><br />&bull;&nbsp;&nbsp;&nbsp; The Sanctity of Human Life Act:&nbsp; In addition, Rep. We must protect the progress we&rsquo;ve made if we want to prevent another tragedy, while we commit ourselves to closing the gaps that still exist.&rdquo;<br /><br />Rep. Cummings fought to ensure a guaranteed dental benefit for children enrolled in the Children&rsquo;s Health Insurance Program as well as the requirement in the Affordable Care Act, which guarantees a pediatric dentistry benefit for every insurance package offered through the Health Insurance Exchange. The ACA also includes investments in oral health infrastructure and the oral health workforce that will help to support a sustainable dental health system.<br /><br />&ldquo;Everyone, but especially our kids, should get to see a doctor and a dentist to get the health care they need to stay healthy,&rdquo; Senator Mikulski said. &ldquo;That&rsquo;s why I was so proud to announce $40 million in new federal funds for the Children&rsquo;s Health Insurance Program to pay for health care coverage &ndash; including dental coverage &ndash; for 137,000 more kids in Maryland. CHIP is so important to families who work every day but can&rsquo;t afford coverage. That&rsquo;s how we honor Deamonte Driver - by making sure that kids and adults get the dental care they need to stay healthy.&rdquo;<br /><br />Maryland has been nationally recognized for leadership in children&rsquo;s oral health. Maryland increased its Medicaid dental reimbursement to 70% of median retail fees, one of the highest reimbursement rates in the country, creating an increase of nearly 85 percent over the past two years in the number of dentists who treat Medicaid patients.<br /><br />&ldquo;Dental decay is the most prevalent and treatable disease among children,&rdquo; said U.S. Senator Ben Cardin. &ldquo;The tragic death of Deamonte Driver made us all very aware that there can be no health without oral health, and we must make sure that every child in America has access to dental care for preventive services and for the treatment of dental disease.&rdquo; <br /><br />Challenges still face the pediatric dentistry community however. Rep. Cummings and Sens. Cardin and Mikulski heard evidence that, while improvements are being made, emergency room visits for pediatric dental care are on the rise, indicating a lack of opportunity for traditional dental care on the part of the underprivileged. As well, only 20 states (including Maryland) are currently receiving grants from the Centers for Disease Control to strengthen oral health programs. These grants are badly needed in all 50 states. <br /><br />Rear Admiral William Bailey, Chief Dental Officer of the United States Public Health Service began the discussion, followed by Jennifer Ryan, Deputy Director of the Children and Adults Health Programs Group at the Center for Medicare and Medicaid Services, Dr. Harry Goodman, Director of the Office of Oral Health at the Maryland Department of Health and Mental Hygiene, Dr. Burton Edelstein, Founding Director of the Children&rsquo;s Dental Health Project and Shelly Gehshan, Director of the Children&rsquo;s Dental Program at the Pew Charitable Trusts. <br /><br />The first panel of experts was followed by Dr. Neuthan Rao, a dentist at Chase Brexton Health Services, a Federally Qualified Health Center, Dr. Leo E. Rouse, Dean of the Howard University College of Dentistry, Dr. Lawrence Caplin, CEO of the Oral Health Impact Project and Grace Williams, the mother of two autistic twins, who could not find a dentist to treat her children.<br />&nbsp;<br />The Forum was held Wednesday at the University of Maryland Carey School of Law, Moot Court Room.<br />&nbsp;</p><p style="text-align: center;">-30-</p>]]>

Cummings, Ranking Member of the House Committee on Oversight and Government Reform, today voted &ldquo;no&rdquo; on the conference report to accompany H.R. 3630, the Temporary Payroll Tax Cut Continuation Act of 2011, because of the major negative impacts it will have on federal workers.<br /><br />The bill will extend the payroll tax cut created by President Obama for the remainder of 2012, while also extending unemployment benefits and adjusting the Medicare &ldquo;doc fix&rdquo; to ensure doctors are fully compensated for serving Medicare patients.<br />&nbsp;<br />However, under some circumstances, unemployment benefits may be cut by 30 weeks, and both unemployment and the &ldquo;doc fix&rdquo; will be paid for in part by requiring newly hired federal workers to pay a higher percentage of their salaries toward pension contributions.<br /><br />&ldquo;Our Federal employees are not a piggy bank. We should not reach into their pockets every time we need to pay for something,&rdquo; said Cummings. &ldquo;In return for their hard work and dedication, the majority has rewarded federal workers with an unprecedented assault on their compensation and benefits. <br /><br />&ldquo;Federal workers have already contributed $60 billion toward the reduction of our Federal deficit. They are now being asked to pay for even more, while we refuse to ask millionaires and billionaires to contribute one additional penny. It is time we stop the assault on our Federal workforce.
